CONTRAVENTION
(JINAAYAAT)
For a male to cover a quarter or more of his head or face with the above mentioned items for one day and one night or more.
For a male to cover less than a quarter of his head or face with the above mentioned items for one day and one night or more.
For a male to cover a quarter or more of his head or face with the above mentioned items for less than one day and one night.
For a female to cover her face touching with the above mentioned items for one day and one night or more, without a valid Shar’ee reason.
For a female to cover her face touching with the above mentioned items for less than one day and one night, without a valid Shar’ee reason.
Without a valid Shar’ee reason, for one Muhrim to cover the head or face of another Muhrim who is asleep.
For the head or face to become covered accidentally while asleep.
Note
- By one day and one night is meant the duration of day and night whether one whole
day or one whole night passes or not e.g. if covered for half the day upto half the
night, or if covered for half the night upto half the day, then too Damm is Waajeeb.
- The same rule applies when a quarter of the face or a quarter of the head is covered.
- If a female uncovers her head then no Jazaa becomes Waajeeb on her.
- A female should cover her face with a cloth in such a way that it does not touch
her face and this is applicable when she fears Fitnah.
- If the head or face is covered during sleep or while awake and such is done willingly
or under duress with or without a valid Shar'ee reason, then under all these circumstances
Damm becomes Waajeeb.
- If the head or face is covered with something which is usually not used for this
purpose, (e.g. a cup, plate, etc.), then no penalty becomes Waajeeb, whether the
whole, (or less than the whole), of the head or face was covered.
- By using an umbrella, no penalty becomes Waajeeb, as it is Jaiz to do so in the state
of Ihraam.
